HOSTESS TABLEWARE RENTAL AGREEMENT

Effective Date: Upon completion of booking

This Rental Agreement ("Agreement") is a legally binding contract between Hostess LLC ("Company", “we” or “our”) and the customer who completes a booking ("Renter", “you” or “your”). By completing your booking, you accept all terms including payment authorization and post-rental charges.

1. RENTAL ITEMS

You are renting the items listed in your order confirmation and corresponding inventory checklist. All items are and remain the exclusive property of Hostess. No title, ownership interest, or lien is transferred to you.

You agree not to alter, modify, resell, gift, engrave, or permanently mark any rented items.

2. RENTAL PERIOD

Standard rental period is 3 calendar days beginning on the scheduled pickup or delivery date.

  • Pickup Window: 4:00 PM–8:00 PM
  • Return Window: 4:00 PM–8:00 PM on Day 3
  • Delivery windows are arranged in advance and require someone 18+ present to sign.

Failure to pick up within the scheduled window is considered a cancellation after pickup time.

3. PAYMENT TERMS

Total Rental Cost = Base Collection + Protection Plan (if selected) + Delivery Fee (if selected)

All charges are calculated on your complete rental cost.

·       At Booking: 25% non-refundable deposit on total rental cost (including sales tax)

·       At pickup or delivery: Remaining 75% rental balance (including sales tax)

You authorize Hostess to charge your card for total rental cost and additional damage or late fees if applicable.

4. POST-RENTAL CHARGES

After your rental period, you may be charged for:

• Damage to items (if no protection plan or damage exceeds protection coverage)

• Missing items at retail replacement cost

• Late return fees

• Any other charges outlined in this Agreement

Post-rental charges are calculated and communicated within 48 hours of return. If there are no disputes within 5 days of notification, charges are final and non-disputable. The card on file will be automatically billed.

If any payment is declined or fails, Hostess will immediately notify via email and give 48 hours to provide an alternative payment method. Failure to provide payment constitutes breach of this Agreement and may be sent to collections.

5. CANCELLATION POLICY

  • Before pickup/delivery: Reservation deposit is forfeited; no additional charges.
  • After pickup/delivery time or no-show: Full rental cost is charged.

No refunds for early returns, unused items, or event-related changes.

6. LATE RETURN FEES

Return deadlines are critical for business operations.

Grace Period: 2 hours (until 10:00 PM, Day 3). Contact us immediately if you will be returning outside of this period

Late Fees:

  • Days 1–3 late: 50% of total rental cost per day
  • Days 4–7 late: 100% of total rental cost per day
  • Day 8+ late or refusal to return: Items treated as lost/theft and full retail replacement value is charged. A police report may be filed where theft is suspected.

Communication prior to deadline may allow reduced fees at our sole discretion.

7. PROTECTION PLANS

Protection applies to accidental damage only and never covers missing items.

Examples of negligence include: exposure to rain, heat/fire damage, dishwasher or disposal use.

If an item is too damaged to safely return, notify us within 24 hours and provide photos; otherwise, charges are processed as missing.

8. MISSING ITEMS

Missing items are charged at full retail replacement value, regardless of protection plan.
A detailed itemized report is provided within 48 hours of inspection.

Example replacement costs:

• Dinner plate: $24

• Salad plate: $19

• Wine glass: $6

• Flatware piece: $3

9. DISPUTE PROCESS

You may dispute charges within 5 days of notification via email with supporting evidence.
Undisputed charged will be processed on day 6 and will only consider requests made after 5 days on a case-by-case basis if extraordinary circumstances prevented timely response. Chargebacks outside this process constitute breach of contract and may be referred to collections.

Valid Dispute Reasons:

• Items claimed missing were actually returned (you provide photo proof)

• Damage existed before rental (you provide pickup inspection photos)

• Charges calculated incorrectly

You agree to:

·       Inspect all items at pickup and document any damage

  • Rinse off visible food residue (no dishwashers, bleach, or harsh abrasives)
  • Store items indoors, dry, secure, and protected
  • Keep items away from extreme heat, moisture, and weather exposure
  • Return items in original crates/packaging

11. INDEMNIFICATION & LIABILITY

You assume all risk of use, including injury, allergy, breakage, or property damage.

To the fullest extent permitted by Washington law:

  • Hostess’s total liability is limited to the amount you paid under this Agreement, and
  • Hostess is not liable for indirect, incidental, punitive, or consequential damages.

You acknowledge that rental items may be vintage, handcrafted, or have natural variations and you assume all risks associated with their use.

12. PRIVACY & DATA HANDLING

Payment information is securely processed through Stripe/Booqable. Hostess does not store full card details locally. Your data will not be sold or shared, except for legal, insurance, or collection purposes.

━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━13. FORCE MAJEURE

Hostess is not responsible for delays or failure to perform due to causes outside reasonable control (ex: extreme weather, natural disaster, illness, power outage, accident, civil unrest, transportation failure). Remedies are limited to refunding fees paid.

14. GOVERNING LAW + ENTIRE AGREEMENT

This Agreement is governed by Washington State law.
This document represents the entire agreement between parties and overrides any verbal statements.
Any amendment must be in writing and signed by both parties.

By completing a booking, you confirm that you have read, understand, and agree to all terms.
